Thank you for using Kickback, a social events and friends app developed and owned byACTIIFY LLC ("we," "us," or "our"). This Privacy Policy describes how we collect, use, anddisclose information when you use our services through the Kickback app ("the App").

Information We Collect

When you use the App, we may collect the following types of information:

  • 1.1. Account Information: When you sign up for an account, we collect your emailaddress, first name, last name, and any other account information you provide.
  • 1.2. Event Information: We collect information about the events you create, attend, orexpress interest in, including event details, location, date, and time.
  • 1.3. Attendance Information: We collect information about your attendance at events,such as whether you RSVP'd, checked in, or marked your attendance.
  • 1.4. Chat Data: We collect the content of messages you send and receive through theApp's chat feature, as well as metadata associated with the messages (e.g.,timestamps).
  • 1.5. Location Information: The App uses your device's location to confirm that you are at or near an event venue when you check in. This check-in feature uses precise location and works by comparing your location to the venue's location within a short radius. We collect precise location only while you are actively using the App and only when you have granted location permission through your device settings. We do not collect your location in the background or track your movements between events. You can grant or revoke location permission at any time in your device settings. If you decline or revoke permission, you can still use the App, but you will not be able to check in at events or receive any venue perks or benefits that depend on check-in.

How We Use Your Information

We use the information we collect for the following purposes:

  • 2.1. To Provide and Improve the App: We use your information to operate, maintain, andimprove the App, including providing features, personalized content, and customersupport.
  • 2.2. Communication: We may use your email address to send you important noticesabout the App, such as updates, changes to our terms or policies, or security alerts.
  • 2.3. Research and Analytics: We may use aggregated or de-identified information forresearch and analytical purposes to understand and improve the user experience.
  • 2.4. Location: We use the location information described in Section 1.5 to verify event check-ins and to enable check-in-based features such as venue perks.

Information Sharing and Disclosure

We do not sell, rent, or share your personal information with third parties outside of theApp, except in the following circumstances:

  • 3.1. Service Providers: We may share your information with third-party service providerswho help us operate, maintain, or improve the App, such as hosting providers oranalytics services. These service providers are authorized to use your information onlyas necessary to provide services to us and are contractually obligated to protect it.
  • 3.2. Legal Compliance: We may disclose your information if we believe it is necessary tocomply with applicable laws, regulations, legal processes, or government requests, or toprotect the rights, property, or safety of our users or others.

Information Visible to Other Users

Kickback is a social app, and parts of your information are visible to other users by design. This is not a sale or disclosure to outside third parties; it is how the App works. Depending on the features you use, other users may see:

3.1. Your Profile: Your first name, last name, profile photo, and any other profile details you choose to add are visible to other users of the App.

3.2. Event Participation: When you RSVP to, check in at, or attend an event, other users, hosts, and attendees of that event may be able to see that you are attending or have attended, and may see you appear as a familiar face based on shared event history.

3.3. Community Features: When you join or post in a Scene, feed, lounge, group chat, or other community feature, your profile and the content you post are visible to other members of that feature. Content you post in a private or limited-access feature is visible to the members of that feature and to any moderator, captain, or host who administers it.

3.4. Messages: Messages you send are visible to their recipients, including all members of a group chat.

3.5. Content Can Travel. Other users may screenshot, save, repost, or share content you post or messages you send, including outside the App. We cannot control what other users do with information you share with them. Please do not post anything you would not want shared beyond the App.

3.6. Visibility Controls. Where the App offers settings that control what other users can see, you can adjust them in your account settings. Some information, such as your name and profile photo, is necessary for the App to function socially and cannot be hidden while your account is active.

Publicity Consent

By using the Kickback app, you acknowledge that local businesses hosting events you attend may take photographs or videos during the event, which may include images of attendees. You agree that these images may be used by the respective local business for promotional purposes, including advertising, social media posts, or within theACTIIFY app itself.

However, if you wish to have a picture removed in which you appear, you can requestremoval directly from the business or email us at support@kickbacksocial.com, andwe will make reasonable efforts to facilitate the removal of such content.

Data Retention and Deletion

We will retain your information for as long as your account is active or as needed toprovide you with the App's services. You have the right to delete your account andassociated data within the App. If you wish to delete your account or request that wedelete your information, please use the account deletion option provided in the Appsettings.

Security

We take reasonable measures to protect the information we collect from loss, misuse,unauthorized access, disclosure, alteration, and destruction. However, please be awarethat no security measures are perfect or impenetrable, and we cannot guarantee thesecurity of your information.

Children's Privacy

The App is not intended for people under the age of 18, and we do not knowingly collectpersonal information from people under 18. If we become aware that we have collectedpersonal information from a person under 18 without parental consent, we will takesteps to remove that information from our servers.

Changes to this Privacy Policy

We may update this Privacy Policy from time to time to reflect changes in our practicesor legal requirements. If we make any material changes, we will notify you by email(sent to the email address specified in your account) or by posting the updated PrivacyPolicy on the App. Your continued use of the App after the effective date of the revisedPrivacy Policy constitutes your acceptance of the changes.
